NOMINATE THE BACHELOR FINDER’S FEE
Terms & Conditions
All applicants submitting a nomination (“Applicant”) must sign statements acknowledging that they have read, understand and will comply with all of the following terms and conditions ("Eligibility")in order to be eligible for the finder’s fee:
1. Applicants are nominating individuals (“Nominees”) to be considered by Producer as the bachelor for the television series, “The Bachelor” (hereinafter the “Bachelor”), and/or as the bachelorette for the television series “The Bachelorette” (hereinafter the “Bachelorette”) anticipated to air during the 2005/2006 or 2006/2007 broadcast season. All Applicants must complete and submit a signed " Nominate America’s Most Eligible Bachelor/Bachelorette” (“Nomination Form”) by September 15, 2006, or by such times AND Syndicated Productions, Inc. (“Producer”) deems necessary in its sole discretion. Applicants must complete a separate Nomination Form for each Nominee they wish to nominate. Additionally, Applicant acknowledges they have read and understand the eligibility requirements for “The Bachelor,” which is available on www.thebachelor.tv.
2. If Producer selects Applicant’s Nominee as the Bachelor/Bachelorette, and the Nominee participates in the Program as the Bachelor/Bachelorette, Producer shall pay a one-time fee of $5,000.00, subject to the Applicant meeting all Eligibility requirements. In the event a particular Nominee is submitted to Producer from multiple sources, and Producer elects to utilize that particular Nominee in the Program as the Bachelor/Bachelorette and he/she participates as the Bachelor/Bachelorette, Applicant agrees the $5,000.00 fee above shall be divided equally among all sources who formally submitted information regarding the particular Nominee selected. If the Nominee who becomes the Bachelor/Bachelorette submitted an application, or he/she was located by Producer, independent of Applicant’s nomination, Applicant will not receive a fee. Applicant understands and agrees that Producer shall have the right, but not the obligation, to select and use Applicant’s Nominee as part of the group of bachelorettes appearing on “The Bachelor,” or as part of the group of bachelors appearing on “The Bachelorette.” The Finder’s Fee shall not be paid in the event Applicant’s Nominee appears in the group of bachelors (as opposed to being featured as “The Bachelor”) on “The Bachelorette,” or in the group of bachelorettes (as opposed to being featured as “The Bachelorette”) on “The Bachelor.”
3. Employees, officers, directors and agents of Producer, Next Entertainment, American Broadcasting Companies, Inc., and all other subsidiaries and divisions of The Walt Disney Company, Telepictures Productions, Inc., and all other subsidiaries and divisions of Warner Bros. Entertainment Inc., Time Warner Inc., all Program advertising, promotional and judging agencies, Program broadcasters and distributors and all other companies associated with the production, administration and/or exhibition of the Program and/or any of their respective licensees, assigns, parents, affiliated and subsidiary companies, divisions, and joint ventures as well as (a) the immediate family (spouse, ex-spouse, mother, father, sister, brother, daughter or son, step-parents, step-children, step-siblings, regardless of where they live), and (b) members of the same households (whether related or not) of such employees, officers, directors and agents; are not eligible to claim the finder’s fee. In addition, any Applicant closely acquainted with any person connected with the production or administration or exhibition of the Program is not eligible if, in Producer's sole discretion, the person's participation could create the appearance of impropriety.
4. After the initial broadcast of the first episode of the Program, Producer will contact all Applicants who meet the Eligibility requirements for the finder’s fee, as determined by Producer in its sole discretion. If, within fourteen (14) days of the initial broadcast, Applicant is not contacted by Producer, and Applicant believes that he/she has met all of the requirements for the finder’s fee, Applicant may request a review of their Eligibility by submitting in writing such request to the Producer at: The Bachelor Finder’s Fee, Attn: Business and Legal Affairs, 3500 W. Olive Ave, 10th Floor, Burbank, CA 91505. All requests must be received by Producer within thirty (30) days of the initial broadcast of the first episode of the Program. Failure to submit a written request for review within this time period will be deemed a waiver by Applicant of any claim to the finder’s fee. Once the request is reviewed and substantiated by Producer to meet the Eligibility requirements, as determined by Producer in its sole discretion, the finder’s fee will be divided and distributed to all eligible sources.
5. Applicant agrees to be responsible for payment of all taxes and insurance applicable under existing law on all amounts paid to Applicant hereunder (if any), including but not limited to, Social Security taxes, Federal, State and Local income taxes. Applicant warrants and represents that Applicant will make all necessary payments due governmental agencies to comply with the foregoing.
6. Applicant acknowledges that all the information they provide on the questionnaire is true and accurate, and any false or misleading information submitted therein is grounds for the immediate elimination of the Applicant’s Nominee from consideration. Applicant further understands that by submitting the Nomination Form, the Producer has no obligation to the Applicant or the Nominee, and may use all information (including Personal Information) as provided therein as the Producer in its sole discretion sees fit with respect to the Program and/or the selection process. The Nomination Form and any other material submitted by Applicant, including, but not limited to, pictures, film and videotapes, becomes the property of AND Syndicated Productions, Inc., shall not be returned and may be used in any manner in all media, worldwide, in perpetuity. Applicant further understands that by submitting this Nomination Form, Producer has no obligation to accept Applicant’s Nominee and the selection and participation of the Nominee in “The Bachelor” or “The Bachelorette” is in no way guaranteed, as it is merely for the purpose of evaluating potential participants. Applicant agree to indemnify and hold Producer harmless from and against any and all claims, losses, liabilities, damages and expenses, including reasonable attorneys' fees, which may result from any breach of the representations and warranties therein.
7. Each Applicant acknowledges, understands and agrees that Producer may disclose any information contained within or derived from his or her Nomination Form to third persons connected with the Program and to compile information from third parties in connection with such Nomination Form and the application process about Nominee’s private, personal and public life, personal relationships with third persons, confidences and secrets with family, friends, significant others, including without limitation: physical appearance; personal characteristics/habits (both physical and mental); medical treatment/history (both physical and mental); sexual history; educational and employment history; military history; criminal investigations, charges and records; personal views and opinions about life, the world, politics, religion, and the like (collectively, "Personal Information"). Applicant acknowledges and agrees that Producer may reveal such Personal Information to third parties in the course of the application process and/or the Program and that Applicant releases, discharges, and holds harmless Companies (as defined below) from any and all claims and damages arising from such compilation or disclosure of Personal Information.
8. Applicants shall treat all information and materials received or acquired about Producer, Companies, the selection process and/or the Program, as strictly confidential and shall not disclose or otherwise disseminate any such information to any third party. Applicants must sign a Confidentiality Agreement in the form presented by Producer, if required by Producer.
9. Applicants understand and agree that the Eligibility requirements may be changed, modified, or amended by Producer in its sole discretion from time to time.
